SEC to Court: Deny Coinbase’s Appeal and Proceed with Crypto Lawsuit

The SEC’s stance came to light on Friday, as it argued that the appeal should not be granted. According to the SEC, allowing Coinbase to appeal could complicate the proceedings without sufficient grounds for such an interruption. This stems from a March 27, 2024, court order that rejected Coinbase’s motion to dismiss the lawsuit, which claims that Coinbase has been operating without proper registration and oversight, potentially affecting investor security.

“Coinbase’s attempts to manipulate the question for appeal to shoehorn it into a certifiable question under 28 U.S.C. § 1292(b) are self-defeating,” the SEC’s lawyers detail.

Coinbase argues that the case involves critical questions of law that could impact the broader cryptocurrency industry, asserting that immediate appellate review was necessary to clarify these legal issues. The platform has contended that without clarity, operating conditions remain ambiguously under a cloud of regulatory uncertainty. The SEC believes the case should proceed.

“The motion scarcely contends otherwise and fails to offer a case with which the order conflicts. Thus, there can be no doubt—let alone a substantial one—that the order was correct and does not meet the standards for interlocutory review,” the SEC noted.

The SEC’s leadership continues to maintain that its enforcement actions are well within its jurisdiction to protect investors and ensure market integrity.
