Former FTX CEO Sam Bankman-Fried formally lodged an appeal against both his conviction and sentence with the District Court for the Southern District of New York (SDNY) on Thursday. Bankman-Fried’s legal representatives had anticipated this move, having previously requested that he remain at New York’s Metropolitan Detention Center (MDC) to facilitate the appeals process.

From Conviction to Court Challenge: Bankman-Fried Takes a Swing at the Appeal Process

On Thursday, Sam Bankman-Fried, the founder and former CEO of FTX, challenged his conviction and sentencing. This action comes two weeks following his nearly 25-year sentence in a California minimum-security facility. Bankman-Fried’s attorneys had indicated an appeal was forthcoming after the 32-year-old was convicted on seven charges of fraud and conspiracy to launder money. Three days earlier, his attorneys had requested that he remain at the Metropolitan Detention Center (MDC) in Brooklyn to support the appeals process.

The grounds for the appeal have not yet been disclosed as the procedure has simply been initiated in the Southern District of New York (SDNY) court system. Defense attorney Marc Mukasey had previously disclosed intentions to take the appeal to the 2nd US Circuit Court of Appeals in Manhattan following the sentencing. The appeal process for Bankman-Fried might extend over several years and could potentially escalate to the U.S. Supreme Court. However, it’s worth noting that filing a notice of appeal does not ensure the appeal will be heard.

Submitting a notice of appeal serves as a formal indication of the intention to challenge a court ruling. Once submitted, the appellate court will review whether the case meets criteria such as the validity of the appeal grounds and compliance with legal procedures. The appellate procedure encompasses multiple stages, including the submission of pertinent documents like transcripts and briefs, and may include oral arguments. Ultimately, it will be up to the appellate court to decide if Bankman-Fried’s appeal will advance.
