Marathon Digital Plant Manager Acquitted in Texas on Noise Complaints Case

David Fischer, a plant manager for a Bitcoin farm operation owned by Marathon Digital, one of the largest crypto mining companies in the U.S., has been declared not guilty on 12 counts of noise violations in North Texas.

Over 40 citizens from nearby tares presented complaints about the noise levels emanating from the facility, which according to Constable John Shirley of Hood County, were measured at over 85 decibels around it. These sound levels could be hazardous and can potentially cause public health issues.

Bob Gill and Miles Brissette, defendants for Fischer and Marathon Digital, stated that these noise level readings were conducted improperly and inflated. Another of the issues with how the case was brought is that the noise citations were issued against Fischer, and the jury had problems linking the manager with the origin of the noise problems, and how much he could alleviate them from his position.

Gill and Brissette also declared that Fischer was not the right person to cite, and stated that it was up to the country to cite Marathon Digital in these proceedings.

Hood County Commissioner Nannette Samuelson expressed her disappointment with this development. In a statement, she said that she was “heartbroken” for the citizens who have to endure the loud noises emanating from the facility. “This is torture for the folks that live near the Marathon Digital Holdings’ data center,” she stressed.

Marathon’s Senior Vice President of Government Affairs Jayson Browder celebrated the decision. He stated:

The jury’s unanimous decision reaffirms our commitment to operating responsibly and ethically. We remain dedicated to being good citizens and working collaboratively with our neighbors for the betterment of the community.
