Montenegro Courts Revisit Extradition Case of Terraform Labs’ Do Kwon Amidst Legal Entanglement
Do Kwon, Terraform Labs’ co-founder, remains in a state of uncertainty regarding his potential extradition to either the United States or South Korea. The legal struggle surrounding his extradition is mired in complexity, with the Montenegro judiciary showing signs of division on the issue. Currently, Kwon has been released from incarceration and is under house arrest while awaiting the outcome of the extradition hearings.
On Friday, the Supreme State Prosecutor’s Office of Montenegro declared that prior rulings have been overturned, necessitating a return of the case to the lower courts. Kwon faces allegations of financial fraud in both the U.S. and South Korea, and his travel companion has already been extradited to South Korea.
“In a situation where there is competition between two states’ requests for the extradition of the same individual, and not a conflict of requests for the extradition of the same individual, as found by the lower courts, the court’s obligation is to determine, in accordance with its powers, whether the legal conditions for the extradition of the accused are met in relation to each request separately, after which the competent minister, not the court, decides on the permission and priority order of extradition,” the Supreme Court of Montenegro ruled.
